Terms of Service

These Terms of Service ("Terms") govern your use of jackhartfitness.com and its subdomains (the "Site") and the online coaching services provided by Jack Hart Fitness FZ-LLC ("Jack Hart Fitness", "we", "us" or "our"), a company registered in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates, Trade Licence No. 47015467. By using the Site or our services, you agree to these Terms.

1. Our services

We provide online fitness and nutrition coaching, including personalised training programmes, nutrition guidance, habit and lifestyle coaching, check-ins and support delivered through our app, messaging and calls. The specific services, duration and price of your programme are set out in the offer and agreement you accept when you join.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our services.

3. Health disclaimer

You confirm that the information you give us about your health is accurate and that you take responsibility for your own health and wellbeing while following our programmes.

4. Results

Client results shown on the Site and in our marketing reflect individual experiences. Results vary from person to person and depend on factors including your starting point, consistency, effort, health and lifestyle. We do not guarantee any specific result unless a written guarantee with stated conditions forms part of your agreement.

5. Consultation calls

Consultation calls are free and carry no obligation to buy. If you book a call, you agree to provide accurate contact details. Our communications with you are governed by our SMS and Call Terms and Privacy Policy.

6. Payments

Fees, payment schedules and any instalment plans are set out at the time of purchase. Payments are processed by third-party payment providers. If you choose a payment plan, you authorise us to charge your chosen payment method on the agreed schedule. You remain responsible for all instalments under your agreement. Prices may be shown in different currencies depending on your location.

7. Cancellations and refunds

Cancellation and refund terms are set out in your coaching agreement. Unless your agreement says otherwise, fees for coaching periods that have started are non-refundable. Any guarantee we offer applies only on the conditions stated in writing in your agreement. To raise a billing question, contact jack@jackhartfitness.com before contacting your bank, and we will work to resolve it.

8. Your responsibilities

• Give accurate information and keep it up to date.
• Keep your app and account login details secure.
• Treat our coaches and team with respect.
• Do not share, resell or publish our programmes and materials.

9. Intellectual property

All content on the Site and in our programmes, including text, videos, guides, workouts, meal plans, logos and branding, is owned by or licensed to Jack Hart Fitness and is protected by intellectual property laws. You may use it for your own personal, non-commercial use only.

10. Third-party services

We use third-party tools such as booking schedulers, coaching apps, messaging platforms and payment processors. Your use of those tools may also be subject to their own terms.

11. Limitation of liability

To the maximum extent permitted by law, Jack Hart Fitness, its directors, employees and coaches will not be liable for any indirect, incidental, special or consequential loss, or for any injury, illness or loss arising from your participation in exercise or nutrition activities. Our total liability to you for any claim relating to our services is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify Jack Hart Fitness against claims, losses and costs arising from your breach of these Terms or misuse of our services.

13. Termination

We may suspend or end your access to our services if you materially breach these Terms or your coaching agreement, including non-payment or abusive behaviour towards our team.

14. Governing law

These Terms are governed by the laws of the Emirate of Ras Al Khaimah and the federal laws of the United Arab Emirates. Disputes will be subject to the jurisdiction of the courts of Ras Al Khaimah, unless the consumer protection laws of your country of residence give you the right to bring a claim locally.

15. Changes

We may update these Terms from time to time. The latest version will always be on this page with its effective date. Continued use of the Site or services after changes means you accept the updated Terms.
